Advice From A Road Accident Solicitor

Thankfully, the majority of us will never need to instruct a road accident solicitor. But of course, there are accidents, so picture this. You're going about your daily business driving your car when you are shunted in the rear by another car. This accidetn was not your fault. In keeping with your legal obligation you swap and exchange details with the other driver and go on your way, planning to call your insurance company later on in the day. Later, back at home, before you have had a moment to call the insurer, there is a knock at your door and there stands a representative of the other driver's insurance company. The lady or gentleman offers you a settlement for your claim on the spot. This, you think, is fantastic!

Nevertheless, a road accident solicitor might suggest that you stop to consider whether this really is the good deal it sounds. It is more common than ever for insurers to contact the claimant making offers of compensation right away. When companies do this it is almost always very promptly. It's hard to believe but some insurance companies have been known to send a representative to the scene of the accident to settle claims there and then.

Whilst all this sounds like a very swift and efficient service, many a road accident solicitor is warning consumers about the practice. Ask yourself why an insurance company would be so keen to settle a claim so quickly. Certainly, claimants should be suspicious of the motives of an insurance company which is trying to encourage them to accept an offer of settlement before the full extent of their injuries is clear.

Road accident solicitors' organisations such as the Association of Personal Injury Lawyers have issued warnings to claimants that under the guise of providing good service, insurance companies are actually trying to save themselves some money. This is because, should they agree to the proposed amount of compensation, the insurance company requires the claimant to sign a form stating that they accept the offer in full and final settlement of the claim. This simply means that once that form has been signed, there is no going back, regardless of any circumstances or injuries which later become apparent and regardless of the involvement of road accident solicitors.

Consumers therefore run the risk of accepting a claim worth less than what they're entitled to and what they may need. After a road accident it is not uncommon for the full extent of injuries to become clear after several days or even weeks. Compensation is partly intended to pay for ongoing treatment of accident victims' injuries, so a full understanding of the extent of the injuries is important before accepting payment. A road accident solicitor would therefore advise that claimants take both legal and medical advice before accepting any offer of settlement.

In order to try and protect consumers from being left out of pocket as a result of this practice, the Association of British Insurers has put together a voluntary code of practice. It states that insurers should make sure that a claimant is aware that they have the legal right to obtain independent legal advice. It also suggests that making initial contact by letter or telephone rather than in person at a claimant's address avoids intimidation.
